Welcome to JAIHO AGRO! These terms of service govern your use of our website located at www.jaihoagro.com operated by JAIHO AGRO.
Our privacy policy also governs your use of our Service and explains how to collect, safeguard and disclose information that results in your use of our webpages.
Your agreement with us includes some Terms and our Privacy Policy. We acknowledge that you have read and understood the Agreements and agree to be bound of them.
If you do not comply with the terms and conditions, then you may not use the service. You may let us know by emailing at [email protected] so that we can find a solution. These terms and conditions apply to all the visitors, users and others who wish to access or use our services.
2. COMMUNICATIONS
By using our services, you agree to subscribe to our newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all of these communications from us by unsubscribing. When you visit Jaiho Agro, you are communicating with us electronically. You will be required to provide a valid phone number and address while placing an order with us. We may communicate with you by e-mail, SMS, phone call, posting notifications on our website or by any other mode of communication.
3. PURCHASES
If you wish to purchase any product or service made available through service, you may be asked to supply certain information relevant to your purchase including your credit or debit card number, the expiration date of your card, your billing address and your shipping information etc.
4. PROMOTIONS
Any kind of promotions made available through our service may be governed by rules that are separate from these Terms of Service.
5. REFUNDS
For having information about the Return or refund of products or any complain by the customer, he/she must abide by the Return and Refund policy thoroughly.
6. PROHIBITED USES
You may use Service only for lawful purposes and in accordance with the given terms. You agree not to use our Services:
1.In any way that violates any applicable national or international law or regulation.
2.To transmit or procure the sending of any advertising or promotional material, including any “junk mail”, “chain letter”, “spam” or any other similar solicitation.
3.To impersonate or attempt to impersonate Company, a company’s employee, another user or any other person or entity.
4.In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent or harmful or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
5.To engage in any other conduct that restricts or inhibits anyone’s use of enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service to expose them to liability.
6.Take any action that may damage or falsify Company rating.
7.Otherwise attempt to interfere with the proper working of Service. 7. ACCOUNTS When you create an account with us, you guarantee that you are at least 18 years of age, and that the information provided by you is accurate, complete and current at all times. Inaccurate, incomplete or obsolete information may result in the immediate termination of the customer’s account. You are responsible for maintaining the confidentiality of his/her account and password. The customer may not use a username as the name of another person or entity or that is not lawfully available for use, a name that is subject to the rights of another person or entity other that himself, without appropriate authorization. Any username that is offensive or obscene should not be used. We reserve the right to refuse service, terminate accounts, remove or edit content or cancel orders in our sole discretion. 8. INTELLECTUAL PROPERTY
Our service and its original content (excluding the Content provided by the users), features and functionality are and will remain the exclusive property of Jaiho Agro and is licensors. Our service is protected by copyright, trademark and other laws. Our trademarks may not be used in connection with any product or service without prior written consent of Jaiho Agro.
9. ERROR REPORTING AND FEEDBACK
Any customer may provide us directly at [email protected] with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints and other matters related to our service. You acknowledge and agree that Feedback does not contain any confidential information or proprietary information from the customer or any third party.
10. WARRANTY
Jaiho Agro warrants every customer that:
It will always make available the products delivered as accurate as possible which are displayed on the Jaiho Agro mobile application or website. If in any case, there is any disparity between the appearance of the products delivered and those which are displayed on the website or the application then, this will not hold against Jaiho Agro.
Any additional charges will not be applied on the products by or in favor of any third party.
Jaiho Agro reserves the right to sell the products to its customers via Jaiho Agro application or website.
Concerned customer will be authorized to the warranties for the product provided by the manufacturer or brand owner.
After the completion of sale, the concerned customer shall enjoy the complete possession of the product purchased by him/her.
Any customer will have to use the Jaiho Agro mobile app or website according to the rules and regulations.
11. LIMITATION OF LIABILITY
If there is any liability found on the part of the company, it will be limited to the amount paid for the products and/or services and under no circumstances will there be any consequential damages.
12. COPYRIGHT POLICY
We respect the intellectual property rights of others. If you believe that your rights are being infringed, you may fill out and submit the Notice Form. It is our policy to respond to right owners and their agents who complete and submit the notice form to communicate concerns about any alleged infringement.
Upon receipt of a notice form we may take certain actions, including removing information or an item, all of which are expressly reserved. Giving false, misleading or inaccurate information in the Notice Form to Jaiho Agro may result in civil and/or criminal liability.
The signed Notice Form can be sent via E-mail PDF OR Fax to the Grievance officer:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest;
- A description of the copyrighted work that you claim has been infringed, including the URL (web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
- Include the following statement: “I have good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.”
- Your address, telephone number or cell phone number and email address;
- A statement by you “the above information in my notice is accurate and that I am the copyright owner or authorized to act on the copyright owner’s behalf.” 13. TERMINATION
We may terminate or suspend your account immediately, without any prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation. If you wish to terminate your account, you may simply discontinue using our Service.
14. GOVERNING LAW
These terms shall be governed and constructed in accordance with the laws of India, which governing law applies to agreement without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered as a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.
15. CHANGES TO SERVICE
We reserve the right to withdraw or amend our service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or part of service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.
16. AMENDMENTS TO TERMS
We may amend our terms at any time by posting the amended terms on our site. Your continued use of the app or website following the posting of revised terms means that you accept and agree to the changes. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to our new terms, you are no longer authorized to use our Services.
17. MODE OF PAYMENT
Payment of the product can be made through Cash on Delivery or the online methods available on Jaiho Agro website. While using any of the payment method, Jaiho will not be considered responsible if any loss/ damage arises due to:
- Exceeding of the preset limit (given by the participating bank)
- Lack of authorization for transaction
- Decline or Cancellation of transaction due to any other reason
- Any payment failure occurring out of the transaction. 18. WAIVER
If you breach these terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any other reason, such provision shall be eliminated such that the remaining provisions of Terms will continue in full force and effect.
19. PRICE
The products and services listed on Jaiho Agro mobile app and Website are sold on MRP (unless otherwise specified) with GST included. Whatever price which will be mentioned at the time when you order will be the price charged from you at the time of delivery.
20. DELIVERY
Jaiho Agro provides home delivery to its customers on any purchase made from Jaiho Agro mobile app or website. Jaiho Agro provides home deliveries for their products and charges a nominal fee for home delivery. At times, when a customer places an online order, the delivery fee is added to the billing amount at the time of checkout.
If any delay occurs in the delivery of orders to the customers due to
(i)any internal reasons or
(ii)the unavailability of the customer;
Jaiho Agro will not be held responsible for the compensation of the inconvenience to the customers.
The customers who are willing to pay Cash on Delivery and they have their Credit or Debit card during delivery time then Jaiho Agro will make available a card swiping machine to its Pilot (delivery boy) if possible, otherwise if the machine is not available or if it does not work, then customer will have to make payment in cash only.
A customer cannot delay the payment of his order which is delivered to him. He has to pay its full payment before delivery or at the time of delivery.
Jaiho Agro has the right to compensate to the customers if any inconvenience that happens other than the two mentioned above. The compensation and the amount of compensation will be given at the decision of Jaiho Agro and it will be paid separately. A customer cannot deduct it from the order amount. The time in which the order is processed is 24 to 48 hours after receiving the online order. Estimated dispatching and delivery time will be provided once the order is placed. If the product delivered to any customer is not in an acceptable condition of if the package is damaged, the customer can refuse to take the delivery and call the customer care number to send a new replaced product. We will try to deliver the new product as soon as possible.
21. ACKNOWLEDGEMENT
By using our Service or other services provided by us, you acknowledge that you have read the terms and conditions properly and agree to be bound by them.
22. MINORS
The service is intended only for the access and use by individuals at least 18 years old. By accessing or using our service, you warrant and represent that you are at least 18 years of age and with the full authority, right and capacity to enter into this agreement and abide by all the terms and conditions. If you are not 18 years old or above, you are prohibited from both using of service and accessing it.
23. PRODUCT CANCELLATION
If any benefit is availed by any concerned customer related to any product of which the customer has cancelled the order, that customer gives his consent and also authorize Jaiho Agro to have recovery from the customer itself.
